“Site, Courses, Services, and/or Products” means www.mindsetplus.co.Content (as defined herein), email list/newsletters, social media posts, blog posts, courses, coaching services, guides, forms, worksheets, workbooks, and/or website materials.

Mindset Plus LLC provides professional coaching services, including one-to-one coaching and blended coaching/consulting engagements. Services are delivered as agreed upon in your individual coaching agreement or service proposal.

We reserve the right to change, amend, or otherwise alter these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Continued use of this website or services after changes are posted constitutes acceptance of the revised terms.

By accessing and using the Site and/or Mindset Plus LLC Services, you agree that the information is provided for general informational purposes only and does not constitute as a substitute for professional business, legal, financial, accounting or therapeutic advice. We are a Certified Professional Coach, not a therapist, mentor, attorney, business and/or financial advisor. Nothing shared during sessions or on this website constitutes advice in any of these regulated fields. You are solely responsible for any decisions you make as a result of your coaching engagement. Mindset Plus LLC treats all client information as confidential and will not disclose personal details shared during coaching to any third party without your consent, except as required by law.

All content on this website — including text, materials, and resources — is the property of Mindset Plus LLC and is protected under United States copyright, trademark, and applicable state intellectual property laws. Content may not be reproduced, distributed, or used without prior written permission. Any materials, frameworks, or resources shared with you during coaching engagements are provided for your personal use only and may not be reproduced, shared, or distributed without prior written permission. You may not represent yourself as affiliated with, endorsed by, or acting on behalf of Mindset Plus LLC. Any violations of these terms will be addressed to the fullest extent permitted by law.
10. Accuracy of Information
Every effort is made to provide up-to-date accurate information both on the Site and through our services. However, due to the complexity of the issues we cover, Mindset Plus LLC does not and cannot warrant, represent, or guarantee that such information is free from errors, accurate, or up-to-date at all times.
11. Refund Policy
We will do everything within our ability (and within reason) to ensure your satisfaction. Refunds will not be issued for coaching services already rendered or products already purchased. If you have any questions or concerns, or if there is anything we can do to make your experience a more pleasant one, please email hello@mindsetplus.co.
12. Payment & Purchases
Fees for services are outlined in your coaching agreement or service proposal. Payment is due as specified therein. Mindset Plus LLC reserves the right to pause or discontinue services if payment is not received in accordance with agreed terms.
Please note, in the event your payment method is declined or incomplete at any time, you are still responsible for the full cost of your Purchase.
All payments are non-refundable unless otherwise stated in writing at the time of purchase. If you need to reschedule a session, please provide at least 24 hours’ notice. Sessions cancelled with less than the required notice may be forfeited without refund at the coach's discretion.
13. Limitation of Liability:
To the fullest extent permitted by applicable law, Mindset Plus LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of this website or participation in coaching services. Total liability shall not exceed the amount paid for the specific service giving rise to the claim.
14. Dispute Resolution & Governing Law
Informal Resolution. If a dispute arises, both parties agree to first attempt resolution in good faith through direct communication. Please contact us at hello@mindsetplus.co before pursuing any formal process.
Small Claims. Either party may bring an individual claim in small claims court in Miami-Dade County, Florida if the dispute qualifies under that court's jurisdictional limits.
Binding Arbitration. For disputes exceeding the small claims threshold, both parties agree to final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, before a mutually agreed-upon arbitrator, in Miami-Dade County, Florida. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.
Fees & Damages. Each party bears their own attorneys' fees and costs, unless the arbitrator finds a claim was brought in bad faith. Any award is limited to a refund of amounts paid for the applicable service. Consequential, punitive, and indirect damages are not available.
No Class Actions. All disputes must be brought individually. You waive any right to participate in a class action or class-wide arbitration.
Governing Law. These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
15. Termination
Mindset Plus LLC reserves the right to terminate or suspend services at any time, with reasonable notice, if a client violates these Terms, engages in abusive or inappropriate conduct, or for any other reason at our sole discretion. In the event of termination by Mindset Plus LLC without cause, any prepaid fees for undelivered sessions will be refunded on a pro-rata basis. In the event of termination due to client violation of these Terms, no refund will be issued for prepaid amounts.
16. Entire Agreement
These Terms & Conditions, together with our Privacy Policy, constitute the entire agreement between you and Mindset Plus LLC regarding use of this website and our services, and supersede all prior communications, proposals, or agreements — whether written, oral, or electronic.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
